New York adults 21 and over may possess up to three ounces of cannabis and 24 grams of concentrate in public, and may store up to five pounds at home. Licensed adult-use retail sales began on 29 December 2022 and are regulated by the Office of Cannabis Management.
Age and identification
You must be 21 or over and you must present a valid, unexpired government issued photo identification. A photograph of an ID on a phone is not accepted, and neither is an expired document. Everyone entering the sales floor is checked, not only the person buying.
This is not store policy, it is license condition. A retailer that gets it wrong risks the license itself, which is why there is no discretion at the door.
Possession limits

What you pay in tax
Adult-use cannabis in New York carries a 9 percent state cannabis excise tax plus a 4 percent local cannabis excise tax, 13 percent in total, applied at retail.
The original potency based tax that taxed products by THC content was repealed effective 1 June 2024 and replaced with a 9 percent excise tax charged at the wholesale level. That change sits upstream of the shelf, so it does not appear as a separate line on a receipt.
Tax schedules change. The New York State Department of Taxation and Finance publishes the current rates, and that is the authority worth checking rather than any retailer's summary, including this one.
Licensed and unlicensed retail
New York has a persistent unlicensed market, and the practical difference for a shopper is testing. Product sold through a licensed dispensary is tested for potency and contaminants and tracked from cultivator to register. Product sold outside that system is not.
Every licensed New York dispensary displays its license and can be verified through the Office of Cannabis Management's public dispensary locator. If a shop cannot show you a license, that is the answer.
Where you can consume
Cannabis may generally be consumed wherever tobacco smoking is permitted under the state's Clean Indoor Air Act, with meaningful exceptions. It is not permitted in a motor vehicle, in a school, on federal property, or in most workplaces, and individual municipalities and property owners add their own restrictions.
Driving is the line that matters most. New York enforces impaired driving law for cannabis the same way it does for alcohol, and an open container rule applies to cannabis in a vehicle.
